Variation to Annual Leave & Shutdown Provisions in Modern Awards

Members were informed by TTIA Circular 1/2023 on 24 January 2023 that on 22 December 2022, a Full Bench of the Fair Work Commission issued a Decision to insert a new model clause into 78 Modern Awards regarding leave during shutdowns (“the Decision”).

A reminder email has been circulated today as the changes take effect from 1 May 2023.

A sample form for taking annual leave and agreement to take leave without pay has been added to our Member Resources on this website.
