Effective 1 July 2024, all modern awards include a delegates’ rights clause. The clause notes that an employer is taken to have complied with their obligations to afford the General Protections entitlements if the employer has complied with the modern award clause.
An additional clause concerning the interaction of the delegates rights clause with other clauses in the award is included in 38 modern awards, providing that more favourable or more beneficial terms in those awards continue to apply instead of the new provisions.
